Legal Question in Tax Law in Georgia

In 2008, my husband and I decided to file married filing separatedly. I filed my taxes online, but since my husband had 1099 income, he went to a local tax preparer. Recently, we received a letter in he mail from our state revenue dept. saying that my husband's taxes were incorrect and showing us the amount he owed. My husband went back to that tax preparer office and found out that the guy who did his taxes is no longer with the company, is wanted by the FBI (unbeknownst to the company back then), and did several people's tax returns incorrectly (including our federal taxes).

What I want to know is... what should we expect to reasonably expect from this company? Do we have a case to sue for negligence? Do we have any right for them to pay for anything on our behalf and if so what?
