I had custody of my son for 8 months during 2009 and my ex husband had custody the remaining 4 months. Who gets to claim our son on their taxes for 2009?

The answer depends on the wording of the custody language in your divorce decree (and also whether there is separate tax language). Since none of us have read it and your lawyer has, no one here can answer you and the lawyer who represented you in your divorce can.
