My husband has been unemployed since april 2009. He owes on a student loan and for the last 2 years our federal income check has been garnished to them. My question is do the dept of education have the right to get our federal income check again this year even tho my husband is unemployed. Thank you. debra

The answer is very simple. Do NOT file a joint return with him. Then you can at least keep your own refund, if one is due.
