Legal Question in Traffic Law in Georgia

Auto Accident

We were on I-75 N. in right lane, a truck passed us in the left lane, he had to brake as not to hit the truck in front of him. All of the sudden the truck pulls in our lane and hits our rental car. The trucker said I'm sorry it was my fault, I thought you were behind me, a Highway worker heard him confess. We don't have the name of the highway worker, I hope somehow to find his name! There were so many accidents that night, that it took the ambulance forever to get there. They took me, my mother, and grandmother to the hospital, while we were there the trooper talked to the trucker at the accident scene, the trucker told the Trooper it was our fault. the trooper talked to us at hospital, he said well I'm getting two conflicting stories. He put on the accident report it was our's and the truckers fault. What can we do? Our insurance, does not cover rental car's, we used our credit card, they are supposed to help, but if they see the accident report says was our fault too.

Re: Auto Accident

There may be a personal injury claim that you may have that may overshadow the concern you raised (if you were hurt), or other things that you should do that would be severly harmed and compromised by (1) not immediately hiring a personal injury lawyer and (2) by your talking to anyone about this without counsel.

See a lawyer IMMEDIATELY and do not talk with anyone until you do. If you wish to speak to my office (and if this happened in Georgia) you'll find contact information at www.glenashman.com .

We would want to see the police report, the rental contract, your credit card insurance paperwork, and any paperwork from the hospital.

ABSOLUTELY TALK TO NO ONE UNTIL YOU RETAIN COUNSEL - not the credit card company, insurers, police, etc. Time is VERY critical here - do not delay acting. A short delay may harm your rights and a long enough delay will prevent you from ever exercising your rights. There is not a charge for the consulation if done via our office.
