Legal Question in Traffic Law in Georgia
hit and run accident
i was involved in a hit and run accident on monday...the police recovered the vehicle but not the driver...the only information the police will release to me is the tag number because the rest of the information was obtained through gcic...so i have no way to contact the driver's insurance company to set up a claim to be compensated for the damages to my vehicle or to even receive a rental vehicle...what are my rights as far as this goes? the police dept. says they will not release the info to me until they find the driver.

Re: hit and run accident
You will need to file a claim against your insurance company, or whatever insurance company was covering your vehicle at the time of the incident. They should handle the claim as an uninsured motorist claim. If they find the other driver, your insurance company will file a subrogation claim to recover the money they spend for your rental, repairs, medical bills, pain and suffering, diminished value, etc.
Be careful how much information you share regarding any injuries. Your insurance company is just as stingy as any other (it is irrelevant that you are their insured). It can be a complicated process.
