Legal Question in Traffic Law in Georgia

incorrect ticket issued to a minor

My son, 17 yrs old, was arrested for racing and reckless driving. He had 2 other passangers that will testify that they were not racing or driving recklessly but were on their way to school when passed by another car speeding. An officer clocked the speeding car from a head on direction, passed and turned to follow. The officer passed my son and stopped the other car. approx 4 miles and a few roads later

the same officer stopped my son as they approached the school. He was presented with 2 tickets - racing and reckless driving. The name of the road written on the ticket is incorrect (not mispelled). They said they were not racing or speeding and he was still taken into custody not read his rights and held for 4-5 hrs before telling him to call me for his s.s. # and booked.

What are his rights at this point?

Re: incorrect ticket issued to a minor

The most important right your son has is the right to make the state prove beyond a reasonable doubt that he was racing and driving recklessly. A conviction for Racing results in a license suspension for ANY driver. Because your son is 17, a conviction for Reckless Driving would result in a license revocation. I would be glad to talk with you about your son's case. My # is 770-384-0407.

Respectfully,

Chris Westmoreland
