Legal Question in Traffic Law in Georgia
Missing speed on ticket
I was stopped for speeding on the interstate, by a county officier. The only thing he didn't write on the ticket was the speed I was suppose to have gone, i.e. 80 in a 65 zone, he just put the 65 zone. Is this legal, is this a valid ticket.

Re: Missing speed on ticket
If he didn't state what speed you were going on the ticket, he has not really accused you of a violation such as will permit the judge to set a fine. Go to court on the appointed date and ask him to dismiss it for failure to state a sufficient charge in his citation. If he denies it, plead not guilty and wait to see what happens and what the cop will claim at the hearing. As long as the cop cited the proper code section, he might still calendar a trial. But, he might not. However, even if he dismisses it on those grounds, it is possible they could send you an amended citation later, but at least you will buy time. It is also possible it will just get lost in the petty "paperwork jungle" and they will never follow up.
