Legal Question in Traffic Law in Georgia
Being Sued for Auto Accident
I was making a left turn onto another street when a car came speeding out of nowhere and hit me. Because the car I was driving had no insurance and an expired tag I initially fled the scene (stupid) but I did return. I was charged with have no insurance, fleeing the scene, and failure to yield. I am currently on probation but I don--name removed--feel that I should be charged with failure to yield considering I did look to see if it was okay to proceed. Now the other driver is suing me for damages to her vehicle. Do I have a chance at fighting this considering I was charged and if so what would be my best method? If I lose I will have no other choice but to file bankruptcy because I can--name removed--afford to pay the $10,000 she asking for in damages.

Re: Being Sued for Auto Accident
Without knowing the whole situation I would hesitate at giving you an answer, but it seems that you would have a tough argument considering the circumstances and the official designation that the accident was your fault.
