Legal Question in Wills and Trusts in Georgia
I am 78 and my wife is 81. My son plans to build an addition on our house so he can be near to take care of us. Wells Fargo told me that if he is the Executor of our will he can take over our payments when we die and stay in the house. I need to be sure before he invests in the addition.

You are asking us for a guess about what WellaFargo will do or what the doments say. We can't possibly answer. All of you need to carefully review all documents.

You need an estate planning/probate attorney to review your will, if any, your heirs and your deed/mortgage, as well as any other assets that you. If you do not have a will, you may want to make one. There are lots of options, but only you and an attorney can thoroughly review your situation to see what makes sense in your circumstances. Don't rely on your mortgage company for legal advice. They do not necessarily have your best interests at heart.
