Legal Question in Wills and Trusts in Georgia

Deceased Left No Will

Mother passed away April 6, 2000, age 87. Have checked safe deposit box, local attornies, and personal papers in home. To best of my knowledge there is no will. I am already on deed to house. I am sole survivor. Father deceased April 7, 1970. Will was probated.

What do I need to do to administer this estate, make final dispositons of property, gain access to bank account, etc.?

Thank you for this service.

Re: Deceased Left No Will

In all likelihood you will file an appropriate petition for appointment as administrator of the intestate estate. Once appointed you will pay any outstanding debts and/or taxes, then distribute the remaining estate.

Depending on the terms of the deed and the size of the remaining estate, it is possible you may be able to avoid a full blown probate of the estate.

I recommend that you stop by the local probate court clerk's office and/or engage an attorney.
