Legal Question in Wills and Trusts in Georgia
charitable trust being abused
Before she died, my brother convinced my mother to give big money to a trust he set up, in which members were to volunteer their time and be paid only for expenses. My brother is taking out a great deal in payment for ''expenses'' that are actually only for his own pleasure. He declines to provide an accounting. How can I force him to provide an accounting? (I am not a beneficiary or trustee, and apparently there are no beneficiaries) The money that he is using for his own benefit would have been in my mother's estate for me to share now, if he had not convinced her on the basis of effecively false statements of how it would be used. How can I get that money back into the estate?

Re: charitable trust being abused
You may wish to seek another attorney's opinion on this matter, but I would have to conclude that if you have no status as either trustee or beneficiary of this so-called trust, that you are likely without legal standing to challenge the manner in which the trust assets are allegedly being used.
