Legal Question in Wills and Trusts in Georgia

Closing of Estate

Estate of late mother entered probate in Feb. 2003. Sold her property. Two mobile homes are on the property with balances due in her name. Mobile homes have been abandoned. There has been no claim against the estate in 4 months for balances or contact from these finance companies. How long will these companies have to file a claim against the estate? Can this go on indefinetly? There is no will.

Re: Closing of Estate

In Georgia, debts of an estate must be paid before the heirs receive anything. In Georgia, estate property where there is no will cannot be sold without Probate Court permission.

If you received Probate Court permission to sell the property, and if all debts have been paid, there should be no problems.

You need to seek the advice of an attorney to make sure you have complied with all legal requirements.
