Legal Question in Wills and Trusts in Georgia

Credit of Deseased

My wife's mother recently and suddenly died. She left little to no estate and no insurance. The children had to split the cost of burial.

We have notified her creditors of her passing (with a copy of the death certificate). They are now sending her bills to us requesting payment. Though we explained the lack of an estate, the bills are still coming. How do we get this to stop. There is nothing to pay them with.

Re: Credit of Deseased

You are not responsible for the debts of the mother. In fact, you are not responsible for handling her estate matters - that is the job of her legally appointed executor or administrator. I would write to each creditor as follows:

You have rendered an invoice in the amount of $_________ to my address for the account of (the mother). Please be advised that (the mother) died on _______, ___, 200__. I am not the legal representative of the "Estate of (the mother)" and I have no responsibility or authority concerning the probate and aministration of her estate. Please direct your inquiries to the Probate Court of _______ County. Please remove me from all future correspondence regarding this matter.
