Legal Question in Wills and Trusts in Georgia

dispute between heirs over inheritance

my husband and his sister inherited estate 6 yrs. ago. still in probate due to conflicts. property line dividing

acreage was disputed. judge made ruling. the second

dispute concerns 30k will said goes to sister. the 30k

was provided in form of certificates of deposit. but judge

said cds already belonged to sis because her name was listed on cds with mother's name. bank wrote or instead or

and. judge says she's got another 30k coming. she won't

sign deeds til she gets this bogus 30k. the problem is that

there is no money in the estate. the only money was the

cds. we had 1 person advise us to have our part of the

property surveyed, draw up deeds of assent, file a motion

to compel before a judge explaining that the money is not

in the estate. maybe he would make her sign the deeds.

your advice? also in the will my husband was given exclusive rights to all the timber on his part of the

property. we need to cut the timber to pay the property

taxes. can we legally do that or do we need permission

from the judge? timber rights have never been disputed by

the sister. please reply. we've already spent thousands

in legal fees. thank you. from, tired of living in limbo.

Re: dispute between heirs over inheritance

I hate to disappoint you, given all that you have already spent, but there is no way to give you reliable advice in this type of forum. I would need to review all the documents, court orders, etc. If you feel you are not getting good representation, you should demand that your lawyer explain everything to you.
