Entitlement

My husband and I had been separated about 7 years before he died, we have 2 children together and were still legally married at the time of his death. Are my kids and I entitled to his estate if he had no will and no other children.

First, let me start by extending my condolences to you and your family. Second, if you where still married and your children are still minor you can file for a year's support on your behalf and your children's behalf. This has to be done through Probate court and I suggest that you contact an attorney, who handles Probate matters, like my firm in order to assist you with this and any further estate issues.
