Legal Question in Wills and Trusts in Georgia
Estate & Will
My husband was a beneficiary of his father's estate; his sister the executrix. My husband passed away after his father, but prior to receiving his portion of his father's estate. My husband had a will, with everything going to me. All other beneficiaries of his Dad's will received their portion 6 months ago. Now that my husband's will has been probated, how long does his sister have to release his portion? Also, she sent a copy of my husband's will to each of his brother's and sister's; none of whom are listed in his will, which seems none of their business....or was that necessary?

Re: Estate & Will
She should distribute your husband's share to his executor immediately--the only reason to delay was to get his will probated.
There was no need to provide copies of his will to his siblings, unless she needed to establish that they were not in fact named. since a probated will is a matter of public record, there would seem to be no harm in it.
