Legal Question in Wills and Trusts in Georgia
Executor
I am the executor of a simple will which directs all property to the husband of the deceased, acting without bond as stated in the will,it specifically states; withot court approval, for the management and distibution of my estate, including independent administration of my estate. My question is, do I have to notify the court of this will to have it validated, or can I just execute the directions?

You must probate the will in the probate court in which the deceased resided. The court will issue an order (Letter Testamentary) formally appointing you as executor. Thereafter, you will not be subject to the statutory bond/inventory/accounting requirements pursuant to the provisions of the will you mention.
