Legal Question in Wills and Trusts in Georgia
Father of 4 had a proven will of which he changed 2 years before his death to exclude 1 child due to his realization that the child had taken a great deal of money from him over the years. This child contested the will but yet his lawyer has done nothing else in court to prove the case. In the interim this child lived in a home owned by the estate and refused to pay rent and would not move out. The estate took him to court and won a judgement of $11,000 and got him evicted (took over a year). The balance of the estate is now $39,000 (without the judgement being paid). It obviously makes no sense financially to continue contesting the will, but rather settle on forgiving the judgement in exchange for dropping the contesting the will. Problem is the lawyers just want to continue to "talk about it" and nothing is being done, they are telling us it could take years to still settle this. We feel taken advantage of...can we ask the judge to make a decision on how to move forward? The will was already "proven" through a series of hearings...the assets have all been sold.

You're represented by a lawyer who knows the facts. We know none of them. When you make the very expensive decision to start a will contest, you don't usually get to decide how it plays out. I am sure the lawyer you hired warned you that these type cases can take years, and you'll need your lawyer to see it through,win or lose. Good luck.
