Legal Question in Wills and Trusts in Georgia

Forgotten Children

My father recently passed and left a will leaving everything to his new wife and step-daughter. He did not mention my sister and I in his will. I was told by one of the witnesses to the will that at the time the will was made he claimed that he did not know where my sister and I were located and that he told the attorney preparing the will that he didn't have any children. I have lived in the same house (which he and my mother purchased) for 24 years (I'm 35 now). My father moved out when I was fourteen and did not keep in contact even though he lived in the same town. Can I contest his will?

Re: Forgotten Children

Although it will depend on the status of the probate proceeding, notice received, etc., it sounds like you have a colorable claim. You should discuss the situation in greater detail with an attorney soon to avoid the loss of your potential claim.
