what forms to file for probate (intestate) for Cobb county?
Deceased 6 years ago; only property is a small home in NC; was resident of Cobb County; all heirs agree on distribution and appointment of one heir for letters; Intestate;

Forms can be accessed for the Georgia probate courts at: http://gaprobate.gov/
Not all forms are there. You can also talk to the clerk of the probate court in Cobb. The problem is that the main estate will have to be probated in Cobb County, Georgia. A second or ancillary estate will then have to be opened in the county in NC in which the home is located. I suggest that the personal representative at least talk to a probate attorney in Cobb. Georgia to find out what all will be involved as that attorney will be able to review any documentation and better advise. It may be that no estate even needs to be probated. Easiest thing would be to sell (all heirs must agree of course) and then divide the money or other assets, provided that all bills/claims have been paid.
