Guardianship of grandmother
My grandmother is 91 and lives at home. For the past year she has had to have 24 hr. care. Now her money has run out. She has never been declared incompetant, but she can not make decisions for herself. There are two daughters and they hate each other. One daughter has been making most of the decisions. Her husband is an attorney. This daughter has now filed for guardianship because she wants to borrow money on my grandmothers home to pay for the care. In the process she has to have my grandmother declared incompetent. There are other assets, but not many and not liquid. In the guardianship papers she is asking for control over all the property my grandparents had, even though the property was divided equally between the sisters and put into their names in a life estate when my grandparents where in their right minds. She has also made it clear that the other sister and her children will not be able to see my grandmother. Can we contest the guardianship that she has filed? Can the guardianship be more than one person? (I don't think she has made the best decisions for my grandmother as far as her money is concerned. Can we have witnesses to testify that she should not in fact be the sole guardian? Thank You

Re: Guardianship of grandmother
You need to see an attorney to advise you in this situation. It is possible to contest a petition for guardianship. There is a time limit. More than one person can be appointed as "co-guardians." If your attorney advises a hearing, there can be witnesses at that hearing.
