Legal Question in Wills and Trusts in Georgia
Heir to house to be sold
My grandmother died in 2000 and willed her home to her four children- When sold the proceeds were to be divided equally- My mother died in 2002- Should her part of the estate ( 25% of the net proceeds of the house) be given to her children (me and my brother)--- My uncle is trying to cut us out of what is rightfully hers- When my Mother died she did not have a will so we probated her estate and split everything between me and my brother- My uncle is saying since my mother had no will that we are not entitled to anything- Thank you

Re: Heir to house to be sold
It depends on the wording of your grandmother's will and the inclusionn, or not, of the phrases "per stirpes" and/or "per capita". These are too complicated to explain in this type of forum. You should have the will reviewed by a local attorney.
