Legal Question in Wills and Trusts in Georgia
Hi, My ex husband who was active duty military killed himself on July 16, 2011. We have one daughter which is his only child. He does have a widow. I filed a Petition for a Year's Support and she is contesting it and saying it is excessive and that his heir doesn't deserve anything because she is receiving his life insurance. Also, my ex husband purchased as a gift a car for our daughter to drive and which was solely in his name and the widow wants us to pay for it. What can I do? Thank you

Get a lawyer immediately before you lose your very important case.
Get a lawyer before you get handed a disaterous loss in this hugely important case. You should have done that before it was filed. Hurry and do it today.
An argument that a child does not "deserve" anything is irrelevant. Your child is entitled to support if there are assets in the estate.
The car is not titled in yours or the daughter's name so its an asset of the estate, not a gift.
Get a lawyer - perhaps something can be worked out depending on the value of the car and what is in the estate.
