My mother recently passed she was in a fatal car accident. We did not file probate there was nothing in the estate to file for she was living in my residence. Her vehicle insurance has settled on her car and I received payment for the car. Does this become part of the estate?

Condolences for your loss. Yes, this insurance settlement becomes part of the probate estate. There is a simplified process for some small estates (usually under $10,000). See if your county has one.
