Parent dies without a will

Both of my parents passed away this year and neither left a will. My brother has moved into my parents house and has no intention of splitting the estate. 1)If I do not pursue the estate at this time, what will happen to it after my brother passes away. Can he, for example, leave the property to his wife, kids, etc. without ever having legally gotten possession of the house. 2) Who is responsible for preparing and/or paying my parents last tax return. 3) Is there a ''statute of limitations'' on pursuing my share of the estate?

1. Presently, you and your brother each own one-half of the estate. It is up to you to pursue your interest. 2. Your parent's estate. 3. I don't know if there is a time within which you must file your claim; usually folks are in a hurry to claim their share.
