Legal Question in Wills and Trusts in Georgia
Parent Passed with no will
If I have the Affidavit for Financial Institutions in order to close my deceased father's checking account, for which to my understanding was created so that a person doesn't have to file a petition for Administration, can a bank still deny me the right to close his account without going and getting the Letter of Administration? And is there a way to cash a reimbursement check that is only $100 without having to file Letter of Administration costing more that what the check is worth to cash? If so what would it be?

You can file a petition to dispense with estate administration if all the heirs agree. See OCGA 53-2-40 and a link to the GA Probate Court forms: http://www.gaprobate.org/forms.php.
Choose item 9 - Petition to dispense with administration.
