Legal Question in Wills and Trusts in Georgia
Power of Attorney Rights and Limitations
My sister in Georgia has POA over my mother. My mother lives alone at her own home and is in her right mind. My sister controls the checkbook, and has been paying bills for her children, ie: house notes, utility bills and etc. from my mothers account without my mothers knowledge. Do I have the right to demand an accounting of my mothers bank accounts and assets? How do I go about doing this?

Re: Power of Attorney Rights and Limitations
If your mother is in her right mind and therefore not in need of a guardian, she can lawfully appoint your sister or anyone else as her POA. You have no rights in the matter at this point. However, you can certainly suggest to your mother that she insist upon an accounting of her affairs.
Re: Power of Attorney Rights and Limitations
A power of attorney may be revoked at any time. You may want to talk to your mother about her options.
