Legal Question in Wills and Trusts in Georgia

Who can probate a will? My grandmother died in Trinidad about twelve years ago. The executor, one of her sons refused to probate her said will in which all her property was left to her children in equal parts. This son claims everthing belongs to him. The family has been in court for a long time. A decision was made to probate the will by the executor's lawyer about 2 years ago. This was not done,and now my lawyer says all the court documents are missing. How can this will be probated?

I'm perplexed why you posted this to Georgia attorneys. It is highly unlikely anyone in Georgia will have any knowledge of the laws of Trinidad.

You say you have a lawyer. Why are you not relying on him? (I am assuming you hired a lawyer in Trinidad as a lawyer in Georgia would be useless as to a national of Trinidad and property there). The best I can tell you is speak to your lawyer from Trinidad.

First, this concerns the laws of Trinidad. A lawyer in Georgia, unless they are admitted in Trinidad, is useless to you.

Second and more importantly, you have an attorney. It is unethical for another lawyer to intervene.

In the US, there are procedures to compel a person to submit a will for probate. I have no idea about the laws of Trinidad, but if your grandmother's son is not doing his job and your lawyer will not a light a fire underr him, then get another lawyer.
