NO. But all wills must be submitted to probate court even if there are no assets to be transferred under the will. However, if the will is not probated there is no creditor protection for unknown debts.

No. Most do need to be probated, although there are exceptions (such as estates with no assets). Without specific facts there's no way to answer you further.
