Legal Question in Wills and Trusts in Georgia
property of an estate
my wifes aunt in her will, said her house was to be sold and after sale expenses proceeds go to my wife. the lady handling the estate has lived int he home for 10 months now rent free. there is a contract on the home and my wife has asked her what the sale price was and what is in the contract. after a phone call, the lady could not give her an actual selling price or anyhting involved in the contrat. we spoke to an attorney and he said we could go and try to have her removed from her duties. not the her or the realtor will give us any information on the sale. we are going to try and contact the administrating lawyer for the estate and ask him if he will get us the answers. if he does not provide the information should we go ahead and go to court even though there is a contract pending on the property? if we do go ahead and get control are we liable to that present contract or can we fire the realtor contract and do it our self.

You already posted the answer: "we spoke to an attorney and he said we could go and try to have her removed from her duties." Hire the attorney and seek to do that if you wish anything done. Delay in doing that could be disasterous.

If you have contacted an attorney then you should employ that individual or another attorney to initiate the actions that are necessary to protect your interests. Dealing with probate, property and administrators is not a do it yourself area of the law, especially when you reside out of state.
