Legal Question in Wills and Trusts in Georgia
Rights of siblings vs executor of the estate
My mother-in-law had her mother pass away 4 months ago. The will states that everything should be split between the remaining 4 siblings equally. This was also confirmed by a judge and all siblings agreed. Since this agreement 2 of the siblings have taken charge and are the only ones with access to the mother's personal property, house, and bank accounts. They have moved everything out of the house, and claim that after bills, etc. have been paid there will be nothing left to split between the siblings. We know that this is not true. There is a considerable amount of equity left as well as personal property. My question is how does my mother-in-law pursue getting an equal share? The sibling who is actually the executor of he estate is the one making all the decisions without notification to the other siblings. He is doing things would seem illegal without any recourse, such as if he has to do anything with any part of the estate he says that he bills the estate a fee. (In many cases he claims the fee to be in excess of $1000) Does my mother-in-law not have legal rights to see an inventory of personal property, bank statements since her mother's death, and any intention on selling the property including appraisel?

Re: Rights of siblings vs executor of the estate
Your mother-in-law needs to retain an attorney to represent her interest in seeing that the estate is settled responsibly, and according to her mother's wishes.
