Legal Question in Wills and Trusts in Georgia

Step Mother holds out on reading will

My neice's father died (cancer)last Nov. She attended the funeral and has not heard from the Stepmother sence. My neice has left her Stepmother many messages but has not heard from her. my neic also checked and the will has not been probated. Her father sold his business before he died and had plenty of money even before. The company is well known in our state. my neice's father told her he made a will and that he was leaving her a certain amount of money.

My neice contacted a lawyer and he said her Stepmother could hold back on reading the will forever unless she hired a lawyer and fought her. They want alot of money up front. My neice has no money and is raising her sisters children who died 3 years ago in a car wreck. They could use some help.

Are there any other options for her? This seems so unfare.

Re: Step Mother holds out on reading will

While I understand that your niece has no money, I am guessing that the stepmother will somehow put up a strong fight, which can be expensive. Unless other family members are willing to help her in terms of an advance, to be repaid if the niece comes into money, she will need to talk to an attorney about taking her case on a contingency (percentage) basis.
