If two siblings are each receiving equal trust checks that was left to them in a Last Will & Testamant from their mother and one sibling passes away, does his portion go to the other sibling or to his children? The sibling had no will.

The first place to start is the trust document. Most trusts make provision for the death of a beneficiary.

It depends entirely on what the trust says.

Ordinarily, it would go to the children, but the terms of the trust govern.
