Legal Question in Wills and Trusts in Georgia

No Will

My father just passed away and did not have a will. He committed suicide. He has three grown children. He was divorced from our mother and was remarried. Our stepmom says he had no money. However, we don't trust she is being totally honest with us. What should we do according to Georgia law? Please note that my father married our stepmom three times. All she has talked about since we found out he was dead is money.

Sounds pretty suspicious to me. Two thoughts occur: Someone (you and/or one or more of your siblings) should file to be named Administrator of the estate. 2. You might want to hire a private investigator to check out the financial situation. I have a good one whom I use.

I cannot give specific legal advice regarding a particular situation over the Internet. I can make comments on general law.

You should seek the advice of an attorney. One or more children can apply to the Georgia Probate Court in the county of the deceased parent's residence to be the Administrator of the deceased parent's estate. As Administrator, or Administrators, the child or children would be able to inquire of banks and other institutions regarding the accounts maintained by the deceased parent.
