Legal Question in Wills and Trusts in Georgia

Will and Living Trust

I would like to create a will and living trust with an online kit (like Suze Orman). Should I have an attorney review the completed documents? What would the average charge for an attorney to review (and file) these documents be after I complete them?

If you need a living trust then you need one prepared properly. It would cost you moe to have a knowledgeable attorney review the trust (if you could find one that would sign off on a kit trust) than it would cost to get one done by an experienced attorney.

There is an attorney directory on the State Bar of Georgia website. Currently it does not list Suze Orman as an attorney in Georgia. Wills and trusts are a very specialized area of Georgia law; therefore, it is worthwhile to invest in a Georgia attorney to draft them. Please do not hesitate to contact me in the event that you wish to pursue this. As a solo practitioner, I try to keep my overhead low in order to make legal services affordable for my clients.

Rethink your plans. First of all, with rare exception, most people do not need living trusts in Georgia. Most of those who might would be those with estates subject to estate taxes (multi-million dollar estates). In the other situations where one might need one, you need a properly custom drafted document.

Wills are too inexpensive and too vital for you to chance the less than adequate online kits. They are "one size fits all states" even though every state law is different, so none are optimal for Georgia. Oftimes, our fee to counsel someone and prepare a will is as low as $150. A consultation to review one you drew would be almost as costly, and likely would result in you paying again to do it right.

If you are in need of a will, and most people are, feel free to contact my office.
