Could there be another will for my mother out there since she had a long term af
My mother passed away in April. She has a legal will with my father written in 1991. The house is in both of their names. The will that my mother has states that if she dies first that everything will go to my father, who is still living. However, she had a long term affair with another man. My father thinks she may have updated the will in the last few years giving her half to the other man. My mother remained married to my father. Is there a way to find out if there is another will, other checking, savings accounts, mutual funds...with the other man. Thank you for considering my request for information. The answer is no. What she does with her will or her estate is her business, and no one elses...until she dies.

If your mother has passed away you can check with the probate court of the county where she died a resident of and see if a will has been filed. If no will has been filed and you have evidence to believe the other man has a will in his possession, you can petition the court to have him file it.
Once an Executor is appointed over your mother's estate he/she can begin to investigate assets held in your deceased mother's name. In your pursuits to handle the estate your father should familarize yourself with Georgia's Year's Support Petition as a remedy he may want to employ in certain situations.
