Wills

On the will, spouse is list as heir unless deceased, then the children are heirs. If some of the children are now deceased, are the heirs only the living children, or do the heirs include living children and children of the deceased children?

The answer completely depends on the wording of the will. Depending on the language, it could be either.

This will depend on whether the bequests to the children are "per stirpes" or "per capita". Ask a local attorney to review the will, if one aleady exists, and explain these terms. If the will has not been prepared, follow the same procedure.
