Legal Question in Workers Comp in Georgia

case against the employer or the insurace company?

my fiance' is a contractor. He has workman's comp coverage. his sister got injured, and she filed claim through an atty against my fiance'. She believe that she is suing the insurance company when in fact the suit is against her brother. can you clear this up for me with a reply to explain to her whether or not she is suing the company that she worked for or the insurance company?

If your fiance does not understand the applicable law well enough to explain it to his sister, then he needs to have an attorney involved. If he has a private work comp plan, then he should notify that entity about the lawsuit.
