company wants me to sign papers removing me from workers comp to Family Medical
I am currently on workers comp for a back injury that happened at work. A MRI reavealed that I had a ruptured disc at spots L-4 and L-5 of my lower back. I have been recieving treatment under workers comp. I have been out of work for 4 weeks under a doctors care. I am recieveing full pay under my companies workers comp insurance.Today I recieved a letter from my employers H.R. department wanting me to to have my doctor fill out and me to sign for Family Medical Leave. I sent them a e-mail today refusing to do so. I informed them this is a workers comp injury and is not a family medical leave problem. I know under the Family medical leave that I would lose all of my rights and could be terminated at there discrestion. Am I right?

There are a number of competing issues at work here. Your fact scenario sounds like you are under a wage continuation program with your employer. It also sounds like it is under a disability pay plan. If so, there may be a reason for you to sign the papers in order to continue the full pay. On the other hand, there may be some very real reasons to look at how your compensation is being handled and make different elections if possible. It is necessary to know exactly what has transpired so far, and determine what the probable outcome of your injury will be with regard to your return to work.
