Legal Question in Workers Comp in Georgia

ER visits

When someone has a work comp injury and is in constant pain and the treating physician does not have an available appt.to see him/her and they end up going to the ER can they get work comp. to pay the bills?

If it is an emergency. You should contact that the doctor and request appmt too.

Absolutely. As long as all medical treatment is reasonably directed to treat the work related injury it should be compensable. That means if the authorized treating physician is unable to treat the injury, an ER visit should be justified. Having said this, an employee cannot become paranoid and rush to the ER for treatment whenever the ATP is unavailabe. The rule is the employer must pay all medical that is reasonable to treat the work related injury.

There is a law that does state that your bills will be covered if it is an emergency. That doesn't mean the employer/insurer will automatically pay the bill without a fight. From my experience, a judge will deem it an emergency if you could not get an appt. with the authorized treating physician within a reasonable amount of time and the employer/insurer did not offer an alternative.
