future medical needs covered?
I was injured on job 08-04-08.Fell backwards from semi truck,fractured left elbow and arm,total 5 fractures.Had surgery that day,repaired with plate and 10 screws.My Dr.has deemed me MMI.There is possibility I will have to have hardware removed in the next 2 years,also likely possibility arthritis in that arm.WC has not approached me re:any form of settlement yet.The case manager said I should not sign off on medical for 2 yrs.Does WC offer this type settlement?I also crushed my prescription glasses in fall,does WC replace glasses?I was semi=retired after 25 yrs. with this employer at time of accident,they do not talk favorably of my returning to work.By law,do they have to allow me to return to work?Will I get a copy of disability rating?I feel like I could do my work,but as my Dr.has said,my left arm will never be like it was before the accident.I have not talked with a lawyer and not sure if I need to,but I don't want to pay future medical bills for this injury should I require further surgery or care.My arm has exceeded the Drs. initial prognosis re:flexion,extension and function.Do I need to contact WC or wait for them.I recieved notice,my last check will be issued next week,but nothing re:impairment rating or anything.

The Workers' compensation insurer must have a clear reason to suspend your workers' compensation benefits. I am surprised to hear that they are sending you your last check so soon after surgery. You will want to have an attorney look at this. Please feel free to contact me directly.

You are entitled to lifetime medical benefits for the injury, not just two years. The case manager does not have your best interests in mind but works for the insurance company to keep their costs down. You have the right to terminate his/her services. You will get money for the impairment rating but you could get a higher rating from a non-company doctor. Your glasses would be covered as well.
