Legal Question in Workers Comp in Georgia

why hire a lawyer?

If workman comp is considered ''no fault'' and no ''pain and suffering'' judgment is allowed, why would someone hire a lawyer? it looks pretty much like the benefits are ''cut and dry''. Am I missing something?

In addition to the observations of Mr. Delius, even if all the calculations are correct, the claim is accepted as compensable, and your medical care is provided, there are significant benefits to be derived by having an attorney, skilled in the area of workers' compensation claims handle your claim.

When valuing a case for settlement purposes, the schedule of indemnity benefits is the starting point. Such issues as future medical care and treatment and the potential for change in condition, just to name a few can significantly effect the value of a case. One who has settled many cases, and has had the experience to know how adjusters and insurers look at issues of exposure, will be far better suited to obtain a favorable settlement than the individual who has been hurt, but has never considered the value of a claim, or how to present it effectively and negotiate it successfully.

You would be surprised to learn how many employers/insurers deny workers' compensation claims and refuse to pay. They often refuse to provide recommended medical treatment, calculate the payments incorrectly, fire employees and/or send them back to work too early or in a job they physically can't handle. The list is quite long. Employees often need a lawyer to enforce their rights.
