Legal Question in Workers Comp in Georgia
Paralyzed
I was involved in an accident on the job about 5 months ago. I fell off of a 3 story building and, as a result, I'm paralyzed from the waist down. I'm really lucky to be alive. So far, the insurance company has paid for most of my medical but not all. And, I havent received anything for loss of income. What do I need to do to get some badly needed money? Thank you.

The best piece of advice anyone can give you at this point is to find a workers' compensation attorney close to you that you trust. Talk to some folks and find someone you feel comfortable with that can guide you through the whole process.

I think that in addition to workers compensation, you should apply for Social Security disability. Your condition should easily meet a listing, meaning that you should be approved quickly.
Be aware, however, that if you apply for SSDI prior to settling your comp claim, you will need to deal with something called a Medicare set-aside.

You are entitled to weekly wage loss benefits if you have more than seven days of lost time due to an injury, which seems likely in your case. These benefits are called temporary total disability benefits (TTD). Your first check should be mailed to you within 21 days after the first day you missed work. You are entitled to receive two-thirds of your average weekly wage; however, there is a cap on the maximum amount of ttd benefits you can receive. Currently, the maximum ttd rate is $500.00. If you do not receive benefits when due, the insurance carrier/employer must pay a 15% penalty which will be added to your benefits.
