In order to fully and adequately answer your question, I would need some additaionl information from you. Such as - have you received any wage loss benefits? Who paid for your medical expenses? If you received wage loss benefits, you have two years from the last receipt of benefits to file a claim. If you did not recieve wage loss benefits, but the workers' compensation carrier was paying for your medical treatment, you have one year from the last date of treatment to file a claim. If they were not paying for your treatment, you have one year for the date of injury to file a claim which means you would have a statute problem. If you do not have a statute problem, you can ask your doctor for a disability rating and seek payment of benefits for the rating. If the Employer/Insurer refuses to pay the disability benefits or you believe you are due other benefits (wage loss or medical), you will likely have to file a hearing request with the State Board of Workers' Compensation.
