Legal Question in Workers Comp in Georgia

I was injured 8 years ago. I had an anterior cervical discectomy w/fusion as a result . I am still under a dr. care. About 2 years in I received a letter from my work comp carrier notifying me they were requesting an IME. They made an appt. with a local psychologist and told me what date & time to be there. In this Dr�s report he stated �quote� �current impairment rating, using the AMA Guidelines, Fifth Edition, would be approximately 25% to the body as a whole. This rating is a result of chronic pain and her depression and does not include any physical impairment that might be applied by her physician.� My physician later gave me an impairment rating of 28% to the body as a whole.
My attorney (which I no longer have) said my disability was 53% to the body as a whole.
What is my payable disability rating? 28% or 53%? And would that be % of 300 or 400 weeks? If this is all owed me where would I find my backup.

If your injury was 8 years ago then your rating period could be 300 weeks. It is possible that your rating could be 53%, but it depends on what was said by each doctor in the rating. I would also like to know if you are currently employed and if you have the same type of job.

You are entitled to alot more than your PPD rating when you go to settle your claim. Please call me to help. I can get a doctor to combine the two ratings to come up with the true PPD rating in your case. There is no charge to call. 404.444.5797.
