statue of limitations

i have a back injury that happen while on the job in 95. in 97 i finally had surgery. in 99 i was taken off of work restricted and have continued to have back pain. i filed a request to change doctors and was approved. on march 18,2001 i fell at work and fractured my eblow. i am still with the company and i am having a hard time getting them to pay for medical treatment. what are the limitations for my case and for how long are they required to cover me. do i have a case against them.

Regarding your back injury, you may have a statute of limitations problem if you have not gotten income benefits within the last two years. Although you may not be entitled to income benefits, you are probably still entitled to medical care. You may also file a "fictional new accident" claim if your job duties have caused your condition to worsen to the point that you can no longer work. As far as you elbow is concerned, this is clearly a new accident and your employer should be covering your expenses. If they aren't, don't waste your time, file a hearing request.
