Legal Question in Workers Comp in Georgia

Statue of Limitations

I had a box containing the framework of a metal building fall on my head at work and knocked me down. I filed a WC report at work but did not go to the doctor. 3 months later I started experiencing neurological pain. I did not connect the nerve pain to the injury until about 6 months later. WC is paying me and handling my operation. I am having a new problem surface due to the severe blow to my head. How long does one have to get legal help should the injury prove to affect for life the work abilities of the the injuried person?

Your help would be greatly appeciated.

Sincerely,

Re: Statue of Limitations

The statute of limitations depends on the exact circumstances of your case. You must file a claim within one year of the date of injury or one year from the last approved medical treatment. If the workers' compensation carrier is paying you indemnity benefits, you have two years from the last receipt of benefits to file a claim. If you are experiencing new symptoms, report it to your treating physician as soon as possible. If the employer/insurer refuses to treat the condition, you will want to file a claim as soon as possible. Good luck and feel free to contact me if you have any further questions.
