Worker's Comp Atty Death
After injury at work, I began speaking with an attorney due to problems w/medical bills not being paid by w/c insurance. I signed contract w/local attorney - he died. Waited brief period and found new attorney. The deceased atty's office is now requesting 25% of any future comp checks and a substantial lien against any future settlement. I had only been client for 3 weeks when attorney died - legally, do I have any choice but to pay?

Usually a workers' compensation attorney will not take a fee unless it was their actions that resulted in the generation of the money (i.e. tried the case resulting in benefits for you). I don't see how the deceased attorney could have put that much time and effort into your case after only three weeks. If you dispute the lien and request for 25% of your benefits, have your new attorney file a hearing request to have a judge determine the amount of money the deceased attorney's office is entitled to.
