Workers Comp benefits
I am currently on leave of absence for a Workers Comp injury. I receive Total Temporary Disability benefits because the employer would not accomodate the Dr.'s restrictions after I had been on the restrictions for over a year. My job will be eliminated as of 2/2/07 due to a company re-org. Will this job elimination effect my receiving TTD benefits? I am also eligible for Long Term Disability from this Company as of 1/18/07. Will this job elimination impact my receiving those benefits as well? I have not received the paperwork from the carrier to start the LTD benefits but the claim has been called in. Please advise

The elimination of your job should not affect your ttd benefits. As long as you remain on light duty and your employer does not accomidate your restrictions and limitations, you are entitled to receive indemnity benefits. If they do try to suspend, I would immediately file a hearing request, seeking penalties for an improper suspension. With regards to the LTD benefits, I assume it would not affect your entitlement to those benefits as long as you remain disabled. However, I would recommend contacting the provider for the LTD benefits and discussing it directly with them. Good luck.

You probably need to consider hiring an attorney, ASAP because you could be facing a loophole capable of depriving you of benefits.

There are many lawyers in larger cities that practice workers comp, or related areas, exclusively. They will be able to help you much better than someone who does not handles these cases full time. They'll be able to give you an opinion pretty quickly.
