14 years ago, my then husband, (an immigrant in Germany), sent me and my daughter home to Indiana with promises to join us within weeks. Long story short - he abandoned me and my daughter. 2 years later, I received a letter from his attorney that he had filed for divorce in Germany with a request for power of attorney. Because of custody concerns, I declined to sign the power of attorney. An attorney in Louisville, Ky, in the state I was working told me-within 6 months, my divorce would go through by default. I sent several letters to his attorney over the next few years with no reponse. I was unable to locate my husband. I assumed I was divorced over time. All attempts to locate any divorce documents failed. Then 7 years later, I remarried. A year later, I was served with divorce papers from my estranged husband in Germany. I informed my new husband and contacted an attorney here in LA who advised me that my new marriage was legal and we did not need to remarry. Now, 5 years later, I have been separated from my current spouse 6 mo. He is threatening charges of bigamy, claiming that we are not married and I have no rights to any marital assets we may have. We own a house together, no children. What should I do?

You really need to contact an attorney in La. to sort out all your legal problems. First, since you received the papers from Germany and did nothing..and later could find no proof of your divorce,did not put you in good faith in your remarriage. I think you got erroneous legal advice. As far as the community property, if the house is in both your names, you own a half interest and owe half the mortgage. Yours, Steve
